Learning Nexus create a new Course Range in response to the Bribery Act 2010

The Bribery Act 2010 updates old, and much-criticised, laws on bribery and also fulfils European Treaty obligations. The Act creates offences which may be committed by individuals as well as an offence by a commercial organisation of failing to prevent bribery.

The penalties for organisations are high, with a criminal conviction leading to unlimited fines and possible exclusion from government contracts across the European Union. For individuals, the maximum sentence is 10 years imprisonment.

There is only one defence to the new corporate offence and that is that the organisation must prove that it had "adequate procedures" in place designed to prevent persons associated with it from undertaking acts of bribery.

Risk assessment and robust written policies and procedures are important elements of these ‘adequate procedures’.

Another crucial aspect of ‘adequate procedures’ is the training of staff at all levels in what constitutes bribery and how to avoid it. Learning Nexus has recognised this training need and has responded by producing a brand new course ‘The Bribery Act 2010: Identifying and Avoiding Bribery in Organisations’. This will be the first course in their 'Ethics in Business' course range, and will be available from July 2011.
